Terms of Use

1. Acceptance of these Terms

These Terms of Use govern your use of:

• the BetKeep iOS application;
• the website at betkeep.app;
• BetKeep accounts, synchronization, support, and related services.

The service is provided by Oleksandr Illarionov, an individual developer based in Ukraine (“BetKeep,” “we,” “us,” or “our”).

By creating an account, selecting the acceptance control presented during registration, purchasing a subscription, or otherwise using BetKeep, you agree to these Terms and the Privacy Policy.

If you do not agree, do not create an account or use BetKeep.

Your use of the iOS application is also subject to applicable Apple terms, including Apple’s Standard End User License Agreement.

2. What BetKeep provides

BetKeep is a personal record-keeping and analytics tool. It allows users to enter, store, synchronize, review, and export information about their own betting activity, bankroll, results, and statistics.

BetKeep is not a bookmaker, sportsbook, casino, betting exchange, gambling operator, tipster, payment provider, investment service, or financial institution.

BetKeep does not:

• accept or place bets;
• transmit, match, settle, or facilitate wagers;
• hold or transfer wagering funds;
• provide independently sourced live odds;
• execute transactions with bookmakers;
• guarantee betting outcomes;
• promise profit or improved results.

Odds, events, bookmakers, stakes, results, and other records shown in BetKeep are entered or selected by users for personal journal purposes.

3. Eligibility

You may use BetKeep only if:

• you are at least 18 years old, or any higher minimum age required by applicable law in your location;
• you are legally permitted to access betting-related services and information in your location;
• your use of BetKeep does not violate applicable law;
• you have the legal capacity to accept these Terms.

BetKeep does not make gambling lawful in any country or region.

Availability through the App Store in a particular country or region does not constitute a representation that betting or any related activity is lawful in that location.

You are responsible for understanding and following the laws and restrictions that apply to you.

4. Accounts

A BetKeep account is required to use the application.

You agree to:

• provide accurate account information;
• maintain control of your email account and protect your password when using email-and-password authentication;
• protect your Apple Account when using Sign in with Apple;
• keep your device secure;
• not share access to your account;
• promptly notify support if you believe your account has been compromised;
• use only accounts that you are authorized to use.

BetKeep supports email-and-password authentication and Sign in with Apple through Supabase Auth.

A BetKeep PIN or biometric lock protects access on an individual device. It does not replace your account sign-in method and does not sign you out of other devices.

Signing out of one device does not necessarily sign you out of other devices.

5. User records and content

You remain responsible for information and images that you enter, upload, import, export, or share through BetKeep.

You represent that:

• you have the right to use the content you provide;
• your content does not violate another person’s rights;
• you will not use BetKeep to store unlawful or malicious content;
• information you provide through support channels will not contain unnecessary sensitive information.

You retain your rights in your content.

You grant BetKeep a limited, non-exclusive license to host, copy, transmit, process, and display your content only as necessary to:

• provide the service;
• synchronize records;
• store profile images;
• create exports;
• provide support;
• protect and maintain the service;
• comply with applicable law.

This license ends when the relevant content is deleted, except where temporary retention is necessary for backups, security, legal compliance, or resolving disputes.

6. Local storage and synchronization

BetKeep uses an offline-first model. Records may exist both on your device and in synchronized server storage.

Synchronization may be delayed or fail because of:

• unavailable internet access;
• service interruptions;
• account problems;
• device restrictions;
• conflicting record versions;
• software errors;
• third-party service failures.

If incompatible versions of a record exist, BetKeep may ask you to choose whether to keep the local or remote version. Your selection may overwrite the other version.

We do not guarantee uninterrupted synchronization or that every change can be recovered.

You should maintain appropriate exports of information that is important to you.

7. Backups, export, and import

BetKeep may allow you to export a backup to a location you select.

Exported backup files:

• may contain betting records, financial records, drafts, settings, custom sports, and images;
• are not encrypted or password-protected by BetKeep;
• may be accessible to anyone who gains access to the file or its storage location;
• remain under your control after export.

You are responsible for:

• choosing a secure storage location;
• protecting exported files;
• deleting copies you no longer need;
• confirming that an import file is correct before importing it.

Importing a backup may completely replace existing local BetKeep data. Eligible imported records may later be synchronized with your account.

BetKeep is not responsible for loss caused by importing the wrong file, storing a backup insecurely, sharing it with another person, or deleting a backup outside the application.

8. BetKeep Pro subscriptions

BetKeep offers auto-renewing BetKeep Pro subscriptions through Apple’s App Store.

Available subscription periods include:

• monthly;
• six months;
• annual.

The products actually available to you, their prices, currencies, taxes, billing periods, and any introductory offer are determined and displayed by Apple before purchase.

8.1 Seven-day free trial

Eligible users may be offered a seven-day free trial.

A free trial is available only if:

• it is offered for the selected product; and
• Apple determines that your Apple Account is eligible.

A trial is not guaranteed to every user.

The App Store purchase screen displays the trial period, price after the trial, and renewal terms.

Unless cancelled before the end of the trial, the subscription automatically renews at the price displayed by Apple.

8.2 Subscription access

Current BetKeep access rules are:

• an eligible trial allows creating and fully editing bets;
• an eligible trial does not allow backup import;
• an active paid subscription allows creating and fully editing bets;
• an active paid subscription allows backup import;
• a subscription in an applicable billing grace period may retain paid access;
• after subscription access ends, existing data remains available for viewing and export, but creating new bets, full editing, and backup import may be restricted.

BetKeep may refine subscription features in future versions. Material changes will be described before they apply.

8.3 Purchase association

A purchase may be associated with both:

• the Apple Account used for the App Store purchase; and
• the BetKeep account active when the purchase was made.

Use the same Apple Account and BetKeep account when restoring subscription access.

8.4 Renewal and cancellation

Subscriptions automatically renew unless cancelled through Apple before the applicable renewal deadline displayed by Apple.

You can manage or cancel a subscription using Apple’s subscription-management controls.

Deleting the BetKeep application does not cancel a subscription.

Deleting your BetKeep account does not automatically cancel a subscription. Apple billing may continue until you cancel through Apple.

8.5 Refunds

Refund requests are handled through Apple’s refund-request process, subject to Apple’s terms and any mandatory rights available under applicable law.

BetKeep does not receive your complete payment-card information.

9. Responsible use

BetKeep is intended for personal record keeping and retrospective analysis.

You must not use BetKeep:

• to violate applicable gambling or betting laws;
• to facilitate unlawful betting activity;
• to gain unauthorized access to another account or system;
• to disrupt or damage the application, website, or infrastructure;
• to introduce malware or harmful code;
• to impersonate another person;
• to infringe intellectual-property or privacy rights;
• for commercial resale or unauthorized redistribution;
• to reverse engineer the application except where applicable law expressly permits it.

Historical statistics, profit and loss figures, return on investment, win rate, and other analytics do not predict future outcomes.

BetKeep does not provide financial, investment, legal, tax, or gambling advice.

You remain solely responsible for your decisions, losses, legal compliance, and personal wellbeing.

If gambling is causing financial or personal harm, stop gambling and seek assistance from an appropriate service available in your location.

10. Bookmakers and third-party names

References to bookmakers, sports, leagues, tournaments, teams, athletes, participants, or other third parties may be:

• entered by users;
• included for organizational or descriptive purposes;
• based on information stored locally in the application.

Unless expressly stated otherwise, BetKeep is not affiliated with, sponsored by, endorsed by, or partnered with any bookmaker, league, team, participant, or other third party.

You are responsible for ensuring that images, names, and other materials you add or share do not violate third-party rights.

11. Third-party services

BetKeep relies on third-party services, including:

• Apple and the App Store;
• StoreKit;
• Supabase;
• Netlify;
• email and support-delivery providers;
• operating-system services selected by you.

Your use of those services may also be governed by their terms and privacy policies.

We are not responsible for third-party services outside our control, including their availability, account decisions, billing systems, network failures, or changes to their terms.

12. Intellectual property

BetKeep, including its software, design, text, graphics, branding, and other materials supplied by BetKeep, is owned by or licensed to Oleksandr Illarionov and is protected by applicable intellectual-property laws.

Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use BetKeep on Apple devices that you own or control and as permitted by applicable Apple usage rules.

No ownership rights are transferred to you.

13. Availability and changes

We may:

• maintain or update BetKeep;
• add, modify, or remove features;
• change technical requirements;
• suspend a feature for maintenance or security;
• discontinue a feature or the service.

We will provide notice of material changes where reasonably possible or required by law.

We do not guarantee that BetKeep will always be available, uninterrupted, error-free, compatible with every device, or able to recover every record.

14. Suspension and termination

We may suspend or restrict access where reasonably necessary to:

• protect account or service security;
• investigate abuse;
• comply with law or platform requirements;
• prevent harm to users or infrastructure;
• address a material violation of these Terms.

You may stop using BetKeep at any time.

You may initiate account deletion through the application. Account deletion is intended to remove the account and associated synchronized BetKeep data, subject to applicable retention requirements and temporary provider backups.

Deleting an account does not delete backup files exported outside BetKeep and does not automatically cancel an Apple subscription.

15. Disclaimers

To the maximum extent permitted by applicable law, BetKeep is provided on an “as is” and “as available” basis.

We do not guarantee:

• the accuracy or completeness of user-entered information;
• the accuracy of statistics derived from incomplete or inaccurate records;
• future betting performance;
• profit or any particular result;
• uninterrupted synchronization;
• permanent availability of third-party services;
• recovery of deleted, overwritten, or conflicting records.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by applicable law, Oleksandr Illarionov will not be liable for indirect, incidental, special, consequential, or punitive damages arising from BetKeep, including loss of profit, wagering losses, loss of data, loss of opportunity, business interruption, or reliance on personal statistics.

BetKeep is not responsible for wagers placed with third parties, bookmaker decisions, betting results, account restrictions imposed by a bookmaker, or losses arising from gambling activity.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including any mandatory consumer rights.

17. Privacy

Our handling of personal information is described in the BetKeep Privacy Policy.

18. Changes to these Terms

We may update these Terms when BetKeep, its features, service providers, or applicable requirements change.

The effective date will be updated when revised Terms are published.

Where required, we will provide notice or ask you to accept materially revised Terms.

If you do not agree to revised Terms, you should stop using BetKeep and may delete your account.

19. Applicable mandatory law

These Terms do not limit rights that cannot be waived under the mandatory laws applicable to you.

Any dispute, claim, or legal issue relating to BetKeep remains subject to the mandatory laws and jurisdiction rules that apply to the parties.

No separate choice of governing law is established by these Terms.
